Two actions, each to recover for injuries alleged to have been sustained as the result of violation of the safe-place statute,
section 101.06 Stats., were brought by Duane Mistele. One was brought against the City of Baraboo and the other against the
Board of Education of the city. Motion for summary judgment dismissing the complaint was made by the defendant is each action.
The motions were granted, in the first named action by judgment entered on December 8, 1953 and in the second on September
22, 1953. Plaintiff appeals from each of the judgments. The facts will be stated in the opinion. GEHL, Justice.
